Roger Bouchard Insurance, Inc., dba Bouchard Insurance (“Bouchard,” “we,” “us,” or “our”) is an insurance agency committed to protecting your privacy through compliance with this privacy policy. 

To arrange for insurance coverage and provide customer service related to insurance coverage, we and other participants in the insurance industry must collect and share personal information of potential and actual customers.

  • Credit and anti-fraud data, including credit history and credit score, information concerning fraud convictions, alleged crimes, or other details from anti-fraud databases, regulators, or law enforcement.

  • To process your registration for one of our webinars or seminars;

Bouchard does not sell your personal information.  Bouchard does not disclose your personal information except as described in this policy or when you expressly consent. We may disclose your personal information:

  • To our service providers and suppliers who are authorized to process your personal information only as necessary to provide services to us.  For example, we use a third-party payment processor to process your payments to Bouchard, and we use third-party service providers to collect your information when you register for one of our seminars or webinars or when you ask for an insurance quote on our website.

  • To other third parties for purposes you have allowed by giving us your prior express consent or to fulfill the purpose for which you provided us the information.  For example, if you wish to purchase an insurance policy, we will provide your personal information to the insurance company that may issue the policy.

  • To enforce or perform an applicable agreement or contract, including for billing and collection purposes.

  • To comply with any court order, law, subpoena, or legal process, including to respond to any government or regulatory request or civil investigative demand.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Bouchard’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Bouchard is among the assets transferred.

7. Automated Quote Platform

Insurance market participants use modeling algorithms and techniques to assess risk and determine whether to provide insurance coverage and the cost and terms of the coverage.  These algorithms and techniques may be automated and based on the personal information you submit when shopping for insurance.  You may submit your personal information to obtain a quote for an insurance product.  When you submit that information to us or through a link on our website, the information goes to one of our service providers, which then matches the information you submitted to the insurers’ coverage criteria to generate a quote.  By submitting your information in this way, you consent to the automated use of your information to generate a quote for potential insurance coverage.

8. Notice and Choice

You can decide whether to provide your personal information to us. If you choose not to provide personal information, you may not be able to take advantage of certain products, services, events, and website features that depend on accurate personal information.

Before we use personal information for a purpose not originally authorized by you, we will provide information regarding the new purpose and ask for your consent to your personal information for the new purpose.  Please note your communication preferences do not affect transactional, relationship, and legally required communications.

You have a right to access and correct (rectify) the record of your personal data maintained by Bouchard if it is inaccurate. You may ask us to erase data or cease or restrict the processing it, subject to certain exceptions and requirements.  You may have the right to object to processing your data and the right to data portability.  You may have the right to withdraw your consent to our use or processing of your personal data, subject to certain exceptions, such as if the processing is necessary to perform a contract with you. You may also ask us not to use your data for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate supervisory authority if you have concerns about how we processes your personal data. When technically feasible and at your request, we will provide your personal data to you or transmit it directly to another controller.

Reasonable access to your personal data will be provided at no cost to Bouchard customers and others upon request made by you or on your behalf to Bouchard’s data protection officer identified above.  If access cannot be provided within a reasonable time, Bouchard will provide a date when the information will be provided. If for some reason access is denied, Bouchard will explain why access was denied, if permitted by law.

11. Children Under 16 Years of the Age

Our website is not intended for children under 16 years of age.  We do not knowingly collect personal information from children under 16.  If you are under 16, do not use or provide information about yourself on this website or on or through any of its features, including your name, address, telephone number, email address, or any screen name or user name you may use.  If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.  If you believe we might have information from or about a child under 16, please contact our data protection officer identified above.

12. Transferring Personal Data from the EU to the US

Bouchard has its headquarters in the United States. Information we collect from you will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the General Data Protection Regulation (“GDPR”). With respect to collection of personal data of individuals in the European Union governed by the GDPR, Bouchard relies on derogations for specific situations as set forth in Article 49 of the GDPR.  Bouchard collects in the U.S. personal data with your consent, to perform a contract with you, or to fulfill a compelling legitimate interest of Bouchard in a manner that does not outweigh your rights and freedoms. Bouchard endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only as consistent with your relationship with Bouchard and the practices described in this privacy policy. 

13. Insurance Providers

An insurance company that issues your insurance policy may have your personal information.  Our privacy policy does not apply to the insurance company’s use or processing of your personal information.  You should review the privacy policy or privacy notice of the insurance company to understand how it collects, uses, discloses, retains, and otherwise processes your personal information.

14. Changes to This Privacy Policy; Agreement to Terms and Conditions

As our organization, products, and services may change from time to time, this privacy policy is expected to change as well. We reserve the right to amend the privacy policy at any time, for any reason, without notice to you, other than the posting of the amended privacy policy at this website. You should check our website frequently to see the current privacy policy and any changes to it.  By using this website, you agree to the terms of this privacy policy.

The provisions contained herein supersede all previous notices or statements regarding our privacy practices and the terms and conditions that govern the use of this website.  By using this website, you agree to the terms and conditions contained in this privacy policy and any other agreement we might have with you. If you do not agree to any of these terms and conditions, you should not use this website or any Bouchard products or services. You agree any dispute over this privacy policy will be governed by the laws of the State of Florida and venue for any such dispute will be in Pinellas County, Florida.  You agree to submit to the personal jurisdiction of the courts in Florida. You also agree to abide by any limitation on damages contained in any agreement we may have with you.

15. Your California Privacy Rights and Do-Not-Track Disclosure

California law permits users who are California residents to request and obtain from us once a year, free of charge, the names and addresses of any third parties to whom we have disclosed their “personal information” (if any, and as defined under applicable California law) for their direct marketing purposes in the prior calendar year, as well as a list of the categories of personal information disclosed to those parties. If you are a California resident and would like to request this information, please submit your request in an email to our data protection officer identified above.

We keep a record of third-party websites accessed when a user is on our website and clicks on a hyperlink.  But we do not track users to subsequent websites and do not serve targeted advertising to them.  We do not, therefore, respond to Do Not Track (DNT) signals.
